NOTICE: Please read these conditions carefully. They constitute a contract between you and the Master and Fellows of Churchill College (referred to below as 'we', 'us' or 'the College') under which the College's free E-mail Forwarding Service is made available to you. This service, including allocation and use of the churchillians.net email address, is defined below as 'the Service'.

1. Registration

The details provided by you on registration are important and must be true, correct and complete. You agree to notify us immediately of any changes which are relevant to your registration using the website https://www.churchillians.net ('the Site').

2. Personal information

2.1 We will respect the privacy of information provided by you on registration and other information relating to you generated in the course of providing the Service ('Personal Information') and undertake to comply with all applicable data protection legislation currently in force.

2.2 You agree that we may use the Personal Information for the following purposes:-
(a) To send you from time to time short e-mail messages with information concerning the College, the Churchill Association and other matters including advertisements or promotions on behalf of affinity partners of the College.
(b) To provide Personal Information to the University of Cambridge Development Office (CUDO) for the purpose of it e-mailing you short messages with links to web pages containing information about events, news, campaigns and other information concerning the University.
(c) To include a strap line on incoming e-mails informing you that they have been forwarded via the Service and providing a link to this website.
(d) To include your name, matriculation year, nickname and churchillians.net e-mail address in a searchable database on the Site (provided you consent to this on registration or subsequently through the Site).

2.3 You acknowledge that the College does not endorse, and makes no representation or warranty concerning, the content of any information that may be provided to you in accordance with the Service including linked websites or other resources, e-mail messages or any goods or services which may be obtained in response to such information. You acknowledge and agree that the College shall not be liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such information or any goods or services available in connection therewith.

2.4 We will not disclose Personal Information to any third party without your permission other than:-
(a) in accordance with these conditions; and/or
(b) for the purpose of properly administering your account; and/or
(c) if required to do so by law; and/or
(d) where requested to do so by the police or other regulatory authority; and/or
(e) in the good faith belief that any disclosure is reasonably necessary to:-
i. enforce these conditions; and/or
ii. respond to any complaint concerning or connected with your use of the Service; and/or
iii. to protect the rights, property or personal safety of the University, the registered users of the Service and the public.

3. Appropriate use of the Service

3.1 You agree that you will only use the Service in a manner that is consistent with these conditions and in compliance with all applicable laws and regulations.

3.2 You acknowledge that all information, data, text, software, music, sound, photographs, graphics, video, messages and other materials are the sole responsibility of the person from whom such content originated. This means that you are entirely responsible for all content that you transmit that is any way connected with the Service.

3.3 You agree that you will not yourself or permit others to in connection with the Service:-
(a) transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful or racially, ethnically or otherwise objectionable;
(b) disguise the origin of any content;
(c) transmit any content that you do not have a right to transmit under any law or contractual or fiduciary relationship;
(d) transmit any content that infringes any intellectual property or other rights of any party;
(e) transmit any unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation;
(f) use the Service in connection with any business;
(g) transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
(h) adversely interfere with or disrupt the Service or servers or networks connected to it.

4. Indemnity

You agree to indemnify and hold the College harmless from any claim or demand (including reasonable legal fees) made by any third party due or arising out of any inappropriate use of the Service by you or any person authorised by you or for whom you are responsible (for example as the parent or guardian of a child).

5. General Practices

You acknowledge that we may establish general practices and limits concerning use of the Service including without limitation the maximum number of e-mail messages and/or the maximum size of any e-mail messages and/or attachments that may be forwarded to you and/or the nature and number of attempts that will be made to forward e-mail messages before attempting to return them to the sender and, in the event of continued failure, discarding them.

6. User name and password

You are responsible for maintaining the confidentiality of your user name and the password assigned to you on registration and are fully responsible for activities that occur in connection with them. You must notify us immediately of any unauthorised use of which you become aware.

7. Access

It is your responsibility to obtain the equipment and pay all telephone and other charges that are necessary to enable you to access and use the Service.

8. Intellectual property

8.1 Your use of the Service carries with it no rights in relation to the name of the College or its logo or trade marks or other intellectual property owned by it.

8.2 You agree that the intellectual property rights in all information and content including any software programs on or available at the Site are owned by the College.

8.3 You are hereby granted a personal, non-transferrable and non-exclusive licence to use the Site for the purposes of the Service for non-commercial purposes only. Other than this you are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, or creating derivative works from such information and content without the prior written permission of the College.

9. Termination/Modifications to service

9.1 The College may terminate your user name, password or use of the Service without prior notice for any reason and you agree that the College may immediately de-activate or delete your account and/or bar any further access to the Service and/or reject any e-mail messages to your terminated churchillians.net e-mail address.

9.2 The College shall not be liable to you or any third party for any termination of your access to the Service.

9.3 You acknowledge that, following termination of your access to the Service, a churchillians.net e-mail address formerly allocated to you may be allocated to another person and that e-mail messages intended for you may be forwarded to such person. The College shall have no liability in this regard.

9.4 The College reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

9.5 You agree that the College shall not be liable to you or any third party for any modification, suspension or discontinuance of the Service.

10. Disclaimer

10.1 We will use our reasonable endeavours to maintain the Service in a fully operating condition and error free. However, we cannot guarantee that this will always be the case.

10.2 Your use of the Service is at your sole risk. The Service is provided on an 'as is' and 'as available' basis.

10.3 Without prejudice to the generality of the foregoing, the College makes no warranty or representation that:-
(a) the Service will meet your requirements;
(b) the Service will be uninterrupted, timely, secure or error-free;

10.4 No advice or information, whether oral or written, obtained by you from us shall create any warranty or other obligation.

10.5 The College shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or other damages, including, but not limited to, damages for loss of profits, goodwill, use, data or any intangible losses resulting from the use or inability to use the Service or any other matter relating to the Service.

10.6 Without prejudice to the foregoing, the liability of the College shall in any event be limited to the level of applicable insurance cover maintained by the College.

10.7 Nothing in these conditions shall affect the statutory rights of any consumer.

11. Change of conditions

We may update these conditions from time to time and we will inform you of any changes by e-mail or by a notice on the Site, which you should review periodically.

12. General

12.1 These conditions constitute the entire contract between you and the College and govern your use of the Service.

12.2 You may also be subject to additional terms and conditions that are applicable to specific products or services offered by the College or others.

12.3 These conditions are be governed by the laws of England and Wales and you and we agree to submit to the exclusive jurisdiction of the English courts.

12.4 Any failure by us to exercise or enforce any right or provision of these conditions shall not constitute a waiver of such right or provision.

12.5 If any provision of the conditions is found by a court of competent jurisdiction to be invalid, you and we nevertheless agree that the court should endeavour to give effect to our intentions as reflected in the provision and other provisions of these conditions remain in full force.

12.6 The section titles in these conditions are for convenience only and have no legal or contractual effect.
